Terms & Conditions

These Terms are between Quantum CorpHealth Pvt. Ltd. ("Company", "we", "us"), incorporated under the Companies Act 2013 with its office in Mumbai, India, and the entity or individual ("Lab", "you") that registers for and uses the Doctor911 LabGrow platform ("Platform").

Doctor911 LabGrow is a cloud-based SaaS CRM and patient engagement platform for diagnostic laboratories. The Platform enables labs to:

• Maintain and manage patient records (CRM)
• Import patient data via CSV upload
• Segment patients by activity (active, due, dormant)
• Send WhatsApp recall and marketing messages via the Interakt API (Doctor911's approved WhatsApp Business Account)
• Track campaign performance and patient engagement
• Manage team members with role-based access

• You must be at least 18 years of age and authorised to act on behalf of the diagnostic lab to register.
• You agree to provide accurate, current, and complete information during registration and to keep it updated.
• One account per lab entity. Sub-accounts ("staff") may be created by the lab admin up to the limit of your plan.
• You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately of any unauthorised access at info@doctor911.life.

You agree that you will NOT use the Platform to:

• Send unsolicited commercial messages ("spam") to patients who have not given explicit consent
• Collect or process patient data without proper consent as required under the DPDP Act 2023
• Upload false or fabricated patient records
• Reverse-engineer, decompile, or attempt to extract the source code of the Platform
• Use the Platform in violation of any applicable law, including the DPDP Act 2023, IT Act 2000, Telecom Regulatory Authority of India (TRAI) regulations, or any healthcare regulation
• Share your API credentials or access the Platform in a manner that circumvents the stated plan limits
• Use the Doctor911 WhatsApp number for purposes not related to patient healthcare engagement

The diagnostic lab (our customer) acts as the Data Fiduciary with respect to its patients' personal data. We act as your Data Processor. You are responsible for:

• Obtaining valid, explicit, purpose-specific, and informed consent from each patient before recording their data or contacting them via any channel
• Ensuring patients are informed of their right to withdraw consent at any time
• Responding to patient data access, correction, and erasure requests within 30 days
• Appointing a Grievance Officer as required under §13 of the DPDP Act
• Not using the Platform to process data of minors without the consent of their parents or lawful guardians
• Promptly notifying us of any suspected data breach involving patient data

Failure to comply with the above may result in immediate account suspension.

• WhatsApp messages are sent from Doctor911's verified WhatsApp Business Account via Interakt, a Meta Business Partner.
• Only Meta pre-approved message templates may be sent. Template content is set by Doctor911 / Quantum CorpHealth and is not customisable by individual labs.
• Sending is subject to Meta's WhatsApp Business Policy and Interakt's terms of service.
• The Platform automatically enforces consent-based sending — only patients with consentWhatsapp = true receive messages.
• The lab is responsible for ensuring the accuracy of patient phone numbers (E.164 format).
• We are not liable for message delivery failures due to incorrect numbers, patient WhatsApp account status, or Meta/Interakt service interruptions.

• The Platform, its UI, branding, and all underlying technology are owned by Quantum CorpHealth Pvt. Ltd.
• "Doctor911" and "LabGrow" are trademarks of Quantum CorpHealth Pvt. Ltd.
• Patient data you upload remains your property. We claim no ownership over your data.
• By using the Platform you grant us a limited licence to process your data solely to provide the Service.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Our total liability for any claim arising under these Terms shall not exceed the amounts paid by you to us in the 3 months preceding the claim.
• We are not responsible for outcomes arising from labs sending messages to patients without proper consent.
• We are not responsible for any clinical or medical decisions made based on data stored in the Platform.

You agree to indemnify, defend, and hold harmless Quantum CorpHealth Pvt. Ltd. and its officers, directors, and employees from any claim, liability, damage, or expense (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any patient's rights under the DPDP Act 2023 or any other law
• Any content or data you upload to the Platform

• By you: You may close your account at any time. On closure, your data is retained for 30 days and then permanently deleted.
• By us: We may suspend or terminate your account immediately (without refund) for material breach of these Terms, non-payment, or if required by law.
• On termination, your right to access the Platform ceases immediately. Patient data export is available for 30 days post-termination.

These Terms are governed exclusively by the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of competent courts in Mumbai, Maharashtra, India.

Parties shall attempt to resolve disputes amicably within 30 days before initiating legal proceedings.

We may update these Terms from time to time. Material changes will be notified at least 15 days before they take effect via email or in-app notice. Continued use of the Platform after that date constitutes acceptance of the updated Terms.
